Guide by the Information Regulator

The Information Regulator has published a guide on how to use PAIA and POPIA, as required by section 10 of PAIA. It is available from the Information Regulator’s website at inforegulator.org.za and on request from our Information Officer. [Confirm the current guide title and link.]

Records available without a request

[List any categories of records automatically available, e.g. marketing material and information published on our website.]

Records held

The following categories of records are held. Listing a category does not mean access will be granted; each request is assessed against the grounds for refusal in PAIA.

  • Company records: [incorporation documents, statutory registers, minutes]
  • Financial and tax records: [annual financial statements, tax returns, VAT records]
  • Personnel records: [employment contracts, payroll, training and registration records]
  • Customer records: [enquiries, quotes, contracts, installation records, Certificates of Compliance, warranty records]
  • Supplier and operator records: [supply agreements, operator agreements]
  • Health and safety records: [incident registers, risk assessments]
  • Records held in terms of other legislation: [list applicable Acts, e.g. Companies Act, Income Tax Act, Value-Added Tax Act, Basic Conditions of Employment Act, Occupational Health and Safety Act and its Electrical Installation Regulations]

How to request access

  1. Complete the prescribed request form ([Form 2 or the current prescribed form]), available from the Information Regulator’s website or from our Information Officer.
  2. Send it to the Information Officer by email or by hand to our physical address.
  3. Give enough detail to identify the record, state the form of access you want and, if you are acting for someone else, include proof of authority.
  4. Pay any prescribed request fee. We will tell you if an access fee or deposit applies.
  5. We will respond within 30 days, which may be extended once by up to 30 days in the circumstances PAIA allows.

Fees

Fees are prescribed in the PAIA regulations. Request fee: [R X]. Access fees: [per the current prescribed schedule]. [Legal reviewer to confirm current fees and any exemptions.]

Grounds for refusal

We may refuse access on the grounds set out in Chapter 4 of Part 3 of PAIA, including to protect the privacy of third parties, commercial information of third parties, confidential information, the safety of individuals and property, and privileged records.

Remedies

If you are unhappy with our decision, you may lodge a complaint with the Information Regulator or apply to court within the period PAIA allows.

Processing of personal information (POPIA)

  • Purpose of processing: [responding to enquiries, quoting, installation, warranty and support, compliance, employment]
  • Categories of data subjects and information: [customers and prospects (contact and site details, photos); employees (identity, employment and payroll information); suppliers (contact and banking details)]
  • Recipients: [operators such as hosting and email providers, subcontractors, authorities where required]
  • Planned cross-border transfers: [hosting and email providers that may process information outside South Africa]
